1. Scope
These Terms and Conditions apply to all orders placed by consumers and businesses with Linkerbaan LLC, 304 S. Jones Blvd, 89107 Las Vegas, United States (“Vitalyris”, “we”) via vitalyris.com and associated order pages. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
2. Contract conclusion
Product presentations on our website are not binding offers. By clicking the order button you place a binding offer to purchase. We accept the offer by sending an order confirmation by email or by dispatching the goods, whichever occurs first. The contract language is English; contract text is stored by us and sent to you with the order confirmation.
3. Prices and payment
All prices are in EUR and include statutory VAT. Shipping costs are shown before order completion. Payment is due on ordering via the payment methods offered at checkout (credit/debit card, PayPal, Klarna, Apple Pay/Google Pay, where available).
4. Delivery
We deliver to Germany and EU member states. Delivery times are stated on the product and shipping pages and are estimates. If a product is unavailable, we will inform you immediately and refund any payment made.
5. Retention of title
Goods remain our property until paid in full.
6. Right of withdrawal
Consumers have a statutory 14-day right of withdrawal; the consumer bears the direct cost of returning the goods. Details, exclusions and the model form are in our Right of Withdrawal & Refund Policy.
7. Warranty and liability
Statutory warranty rights apply. We are liable without limitation for intent, gross negligence, injury to life, body or health, and under the Product Liability Act. For slight negligence we are liable only for breach of essential contractual obligations, limited to foreseeable, typical damage.
8. Food supplements – important notice
Food supplements are not a substitute for a varied, balanced diet and a healthy lifestyle. Do not exceed the stated recommended daily dose. Keep out of reach of small children. Consult a doctor before use if you are pregnant, breastfeeding, taking medication or have a medical condition.
9. Dispute resolution
EU online dispute resolution platform: ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution before a consumer arbitration board.
10. Final provisions
The law of the United States of America applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer-protection provisions of the country of your habitual residence remain unaffected. Should any provision be invalid, the remaining provisions remain in force.
